Ding Dong the Flag is Dead!
Astounding good news: the DC Court of Appeals just bitchslapped the FCC and the MPAA for trying to break our TVs. The broadcast flag, which would regulate recording, moving, or copying digital broadcasts, is now dead in the water. The court did a great job, specifying that regulating the non-broacast features of a device was beyond the FCC’s scope, and that specific legislation would have to be adopted by Congress to give them that ability if the broadcast flag is to live on. Since no congressperson wants to be responsible for breaking their constituents’ TVs, this is highly unlikely. Which means we win, scraping in just under the July 1st deadline.
